Acceptance of Terms
By accessing and using remitselect.com (the "Platform"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"). These Terms constitute a binding agreement between you and RemitSelect.
If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Platform. Your continued use of the Platform constitutes acceptance of these Terms as they may be amended from time to time.
RemitSelect reserves the right to modify these Terms at any time without notice. Changes are effective immediately upon posting to the Platform. Your continued use of the Platform following any modification constitutes acceptance of the modified Terms.
Use License
RemitSelect grants you a limited, non-exclusive, non-transferable license to access and use the Platform solely for lawful purposes and in accordance with these Terms. This license does not include the right to:
- Modify, copy, or create derivative works of the Platform or its content
- Reverse engineer, decompile, or discover source code or underlying algorithms
- Remove, alter, or obscure any proprietary notices, labels, or marks
- Rent, lease, sell, or transfer the Platform or access rights to any third party
- Use the Platform for any commercial purpose or in competition with RemitSelect
- Collect or track personal information of others without consent
- Spam, harass, abuse, threaten, or otherwise violate the rights of others
- Upload viruses, malware, or other malicious code
Any use of the Platform that violates these restrictions is prohibited and may result in immediate termination of your access without refund or notice.
Independent Service
RemitSelect does not process money transfers. We operate as an independent comparison and referral platform only. When you click through to a remittance provider and initiate a transfer, you are contracting directly with that provider, not with RemitSelect.
RemitSelect is not a money services business, payment processor, or financial institution. We do not hold, transfer, or control any user funds. All transfers, rates, fees, and services are provided exclusively by the third-party providers listed on our Platform.
Your use of any third-party provider is governed solely by their terms of service, privacy policy, and applicable regulations. RemitSelect has no responsibility for the actions, omissions, products, services, or policies of any third-party provider.
You acknowledge and agree that RemitSelect is not responsible for any losses, disputes, delays, or issues arising from your use of third-party providers. Any complaints or disputes must be directed to the relevant provider, not RemitSelect.
Disclaimer of Warranties
RemitSelect provides the Platform on an "AS IS" and "AS AVAILABLE" basis without any representations or warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to:
- Accuracy, completeness, or reliability of any information or data on the Platform
- Suitability of the Platform for any particular purpose
- Uninterrupted, error-free, or secure operation of the Platform
- Merchant status or regulatory compliance of listed providers (verification is at the time of listing only)
- Equivalency of rates, fees, or terms across different providers or time periods
Exchange rates and provider information displayed on the Platform may not reflect current rates in real time. RemitSelect does not guarantee the accuracy of any third-party provider data, pricing, or service availability. Rates and offers are subject to change without notice.
Limitation of Liability
To the fullest extent permitted by law, RemitSelect shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of funds, profits, revenue, or business opportunities
- Loss of data, work, or business interruption
- Personal injury or property damage
- Damages arising from use of third-party providers or their services
- Unauthorized access to, alteration of, or loss of your personal data
- Any claim arising from your reliance on information provided on the Platform
This limitation applies regardless of whether RemitSelect was advised of the possibility of such damages and even if any remedy fails of its essential purpose. Some jurisdictions do not permit the exclusion of certain damages, in which case this limitation shall apply to the maximum extent permitted.
Indemnification & Liability
You agree to indemnify, defend, and hold harmless RemitSelect, its owners, operators, employees, and agents from any claims, demands, damages, losses, or costs (including legal fees) arising from:
- Your violation of these Terms or any applicable law
- Your use of the Platform or access to third-party providers
- Your breach of any third-party provider's terms of service
- Any claim by a third party related to your use of the Platform
- Any dispute with a third-party provider or regarding a money transfer
You remain solely responsible for monitoring your accounts with third-party providers and for addressing any issues directly with the relevant provider. RemitSelect assumes no responsibility for third-party conduct or services.
Termination of Access
RemitSelect may, in its sole discretion, suspend or terminate your access to the Platform at any time, with or without notice or cause. Grounds for termination include, but are not limited to:
- Violation of these Terms or any applicable law
- Fraudulent, abusive, or harassing conduct
- Automated scraping, crawling, or unauthorized data collection
- Circumvention of security measures or access controls
- Use of the Platform for commercial or competitive purposes
- Any conduct RemitSelect determines to be harmful to the Platform or other users
Upon termination, all rights granted under these Terms immediately cease. Your obligation to comply with these Terms survives termination.
Intellectual Property
All content on the Platform, including text, graphics, logos, images, design elements, and software ("Content") is the exclusive property of RemitSelect or its content providers and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, adapt, publish, translate, or transmit any Content without prior written consent from RemitSelect. Unauthorized use of the Content is strictly prohibited and may result in legal action.
RemitSelect® and associated logos and marks are trademarks of RemitSelect. Unauthorized use of these marks is prohibited.
Governing Law
These Terms are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles. You agree that any legal action or proceeding arising under these Terms shall be exclusively subject to the jurisdiction of the courts of England and Wales.
You irrevocably submit to the exclusive jurisdiction of these courts and waive any objection to venue or inconvenient forum. This choice of law and jurisdiction clause is binding and enforceable.
